Terms and Conditions

Dawn Kaseoru Art, LLC Commissioned Artwork Terms and Conditions:

1.  Agreement to Commission: By commissioning artwork from Dawn Kaseoru Art, LLC, you agree to be bound by these terms and conditions, which constitute a legally binding agreement between you and Dawn Kaseoru Art, LLC. If you do not agree with any part of these terms, you must not commission artwork from us.

2.  Commission Process: The commission process involves discussing the scope of the artwork, including subject matter, size, medium, style, and any specific requirements. Once the details are agreed upon, a written agreement or contract will be provided outlining the terms of the commission, including pricing, payment schedule, delivery date, and any other relevant information.

3.  Payment: A non-refundable deposit may be required to secure the commission. The remaining balance is typically due upon completion of the artwork and before delivery. Payment methods accepted may include bank transfer, PayPal, or other agreed-upon methods. Failure to make payment as agreed may result in cancellation of the commission and forfeiture of the deposit.

4.  Ownership and Usage Rights: The commissioned artwork, including all intellectual property rights, remains the property of Dawn Kaseoru Art, LLC until full payment is received. Upon receipt of full payment, ownership and usage rights of the artwork may be transferred to the client as outlined in the commission agreement. Dawn Kaseoru Art, LLC retains the right to use images of the commissioned artwork for promotional purposes, unless otherwise agreed upon in writing.

5.  Artistic Freedom: While we strive to accommodate the client's preferences and specifications, artistic interpretation and creative freedom remain with the artist. Minor adjustments may be made during the creative process to ensure the best possible outcome for the artwork. Significant changes or revisions requested by the client may incur additional fees.

6.  Delivery and Shipping: The completed artwork will be delivered to the client according to the agreed-upon delivery date and method. Shipping costs and insurance, if applicable, will be paid for by Dawn Kaseoru Art, LLC and outlined in the commission agreement. Dawn Kaseoru Art, LLC is not responsible for any damage or loss that occurs during shipping.

7.  Satisfaction Guarantee: We want you to be delighted with your commissioned artwork. If, for any reason, you are not satisfied with the final result, please contact us to discuss potential solutions. While we cannot offer refunds on commissioned artwork, we will work with you to address any concerns and ensure your satisfaction to the best of our ability.

8.  Confidentiality: Dawn Kaseoru Art, LLC respects the privacy and confidentiality of our clients and their commissioned artwork. Any personal or sensitive information shared during the commission process will be kept confidential and used only for the purpose of completing the commission.

9.  Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of United States, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Fremont County, Colorado.

10. Changes to Terms: We reserve the right to modify or update these terms and conditions at any time without prior notice. Any changes will be effective immediately upon posting on our website or notification to the client. It is your responsibility to review these terms and conditions periodically for changes.
